By downloading, accessing, or using the Aoria mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Aoria (“we,” “us,” or “our”). Please read them carefully before using our services.

Your continued use of the App following any updates to these Terms constitutes acceptance of those changes.

Description of Service

Aoria is a mobile application that provides:

• Skin Analysis: AI-powered analysis of skin photos to identify skin type, conditions, and concerns.
• Personalized Recommendations: Suggestions for skincare routines and products based on your skin profile.
• Progress Tracking: Tools to monitor changes in your skin over time through journal entries and scan history.
• Product Analysis: Scanning and evaluation of skincare products.
• AI Assistant: Chat-based guidance for skincare questions.

The accuracy and effectiveness of our analysis depends on various factors including photo quality, lighting conditions, and the limitations of AI technology.

Medical Disclaimer

Not a substitute for professional care

• The skin analysis, recommendations, and information provided by the App are NOT a substitute for professional medical advice, diagnosis, or treatment.
• Always seek the advice of a qualified dermatologist, physician, or other healthcare provider with any questions regarding a medical condition.
• Never disregard professional medical advice or delay seeking it because of something you read or received through this App.

No doctor-patient relationship

Use of this App does not create a doctor-patient or healthcare provider relationship between you and Aoria.

Consult a professional

If you have or suspect you have a skin condition, disease, or health problem, consult a healthcare professional immediately. Do not rely on this App for diagnosis or treatment decisions.

Emergency situations

If you are experiencing a medical emergency, call your local emergency services immediately.

AI limitations

Our AI-powered analysis has inherent limitations and may not accurately identify all skin conditions. Results should be interpreted as general guidance only, not definitive medical conclusions.

Eligibility

To use the App, you must:

• Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction).
• If under 18, have parental or guardian consent.
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the App under applicable laws.

By using the App, you represent and warrant that you meet all eligibility requirements.

User Accounts

Account creation

You may need to create an account to access certain features. You agree to:

• Provide accurate, current, and complete information.
• Maintain and update your information as needed.
• Keep your login credentials confidential.
• Notify us immediately of any unauthorized access.

Account responsibility

You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

Account termination

We reserve the right to suspend or terminate your account at any time, for any reason, including violation of these Terms.

User Content

Your content

You retain ownership of photos, journal entries, and other content you submit through the App (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely for the purpose of providing and improving our services.

Content guidelines

You agree that your User Content will not:

• Violate any third-party rights.
• Contain illegal, harmful, or offensive material.
• Include content that is not your own skin or for which you lack permission.
• Attempt to deceive or manipulate our analysis systems.

Content removal

We reserve the right to remove any User Content that violates these Terms. You may delete your User Content at any time through the App settings.

Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorized access to our systems.
• Interfere with or disrupt the App’s functionality.
• Reverse engineer, decompile, or disassemble the App.
• Use automated systems to access the App without permission.
• Impersonate any person or entity.
• Upload malicious code or content.
• Use the App to harm others or yourself.
• Share your account with others or create multiple accounts.
• Circumvent any access restrictions or usage limits.
• Use the App in any way that could damage our reputation.

Violation of these rules may result in immediate termination of your access.

Intellectual Property

Our intellectual property

The App, including its design, features, content, algorithms, and underlying technology, is owned by Aoria and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App without our written permission.

Trademarks

All trademarks, logos, and service marks displayed in the App are our property or the property of their respective owners. You may not use them without prior written consent.

Feedback

If you provide suggestions, ideas, or feedback about the App, you grant us the right to use such feedback without any obligation to you.

Disclaimers

“As is” and “as available”

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

No warranties

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose.
• Accuracy, reliability, or completeness of any information.
• Uninterrupted or error-free operation.
• Security of data transmission.
• Absence of viruses or harmful components.

No guarantee of results

We do not guarantee any specific results from using the App. Skin analysis results may vary and should not be relied upon as definitive assessments.

Third-party content

We are not responsible for any third-party content, products, or services referenced in the App.

Limitation of Liability

To the maximum extent permitted by applicable law:

• Aoria, its officers, directors, employees, and agents shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages.
• This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses.
• Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Acknowledgment

You acknowledge that this limitation of liability is a fundamental element of the agreement between you and Aoria, and we would not provide the App without these limitations.

Indemnification

You agree to defend, indemnify, and hold harmless Aoria, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use or misuse of the App.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Your User Content.
• Any medical decisions made based on information from the App.
• Any claim that your use of the App caused damage to a third party.

This indemnification obligation will survive termination of your account and these Terms.

Termination

Termination by you

You may stop using the App and delete your account at any time through the App settings.

Termination by us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms.
• Fraudulent, abusive, or illegal activity.
• Conduct that may harm other users or the App.
• Extended periods of inactivity.

Effect of termination

Upon termination:

• Your right to use the App will immediately cease.
• We may delete your account and User Content.
• Provisions that by their nature should survive termination will remain in effect (including disclaimers, limitations of liability, and indemnification).

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the “Last updated” date at the top.
• For material changes, we will notify you through the App or via email.
• Your continued use of the App after changes constitutes acceptance.

If you do not agree to the modified Terms, you must stop using the App and delete your account.

We encourage you to review these Terms periodically to stay informed of any updates.

Governing Law

Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits against us.

Venue

Any legal proceedings shall take place in the courts located in the United States.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aoria regarding the App.
